To apply you must:

  • have a partner who is a New Zealand citizen or resident
  • be living with your partner in a for at least 12 months
  • have your visa application supported by your partner
  • meet the other requirements of this visa.

This visa lets you:

  • live, work and study in New Zealand
  • include your dependent children aged 24 or younger in your visa application
  • apply for permanent residence after having this visa for at least 2 years in a row.

If your partner has New Zealand residence through an Australian passport, Australian residence or resident return visa, they must live in New Zealand.

If your partner is a New Zealand citizen and you have been living together overseas for at least 5 years, we may give you a Permanent Resident Visa.

How long you can stay

A Partner of a New Zealander Resident Visa lets you stay in New Zealand indefinitely.

After you have had this visa for 2 years in a row, you can apply for a Permanent Resident Visa that lets you travel in and out of New Zealand indefinitely.

While you are in New Zealand

Who can apply

To apply for this visa, you must:

  • have a partner who can support your application, and is a New Zealand citizen or resident — if they have New Zealand residence through an Australia passport or an Australian residence or resident return visa, they must live in New Zealand
  • be living with your partner in a genuine and stable relationship for at least 12 months when you apply
  • be in good health
  • be of good character. 

Eligible partner

Your partner must not have supported a successful resident visa application for more than 1 previous partner.

Within the past 5 years they must not have:

  • supported a successful resident visa application for a previous partner
  • included a previous partner in their own successful residence application
  • have themselves been included as a partner in a successful residence application.

They must not be liable for deportation or have their deportation liability suspended.

Your partner must complete the 'Partnership Support Form for Residence' as evidence of their support.

Note

Your partner must be at least 18 to support your application or have permission from their parent or guardian if they are aged 16 or 17.

Your partner's immigration status

Your partner must be a New Zealand citizen or resident.

Your partner must provide their:

  • New Zealand passport
  • New Zealand birth certificate
  • certificate of New Zealand citizenship, or
  • New Zealand residence visa.

If your partner has New Zealand residence because they are an Australian citizen or Australian permanent resident, they can provide their:

  • Australian passport
  • Australian Permanent Resident Visa, or
  • Australian Resident Return Visa.

If applying on paper, the document must be an original or a .

If you have been living with your partner outside of New Zealand

We may give you a Permanent Resident Visa instead, if:

  • your partner is a New Zealand citizen, and
  • you have been living together outside of New Zealand in a for 5 years or more when you apply.

When you apply for a Partner of a New Zealander Resident Visa, your partner will need to:

  • be outside of New Zealand, or
  • have been back in New Zealand for less than 3 months.

Your partner's place of residence if they are Australian

If your partner has New Zealand residence because they are an Australian citizen or Australian permanent resident, they must live in New Zealand.

Documents your partner can provide to show they live in New Zealand include:

  • letters or bills addressed to them — for example, electricity or other utility bills
  • employment records
  • records of benefit payments from Work and Income, or tax records from Inland Revenue
  • mortgage, tenancy or utility supply agreements
  • invoices or receipts showing their household effects have been moved to New Zealand.

Relationship with your partner

You will need to provide documents that show you and your partner have been living together in a for at least 12 months at the time you apply. 

The evidence should show:

  • how long you have been together in a relationship
  • how long you have been living together
  • you share finances and/or other responsibilities
  • you spend time together, for example, photos together, and emails and social media conversations between you
  • other people recognise your relationship
  • if you are aged 16 or 17, your parent or guardian supports your partnership
  • anything else you think shows you and your partner are living together in a genuine and stable relationship.

Note

You and your partner must be planning to live in New Zealand for the same period of time.

Your partner's character

Your partner must meet our good character requirements or have a .

They must get police certificates from:

  • countries they are a citizen of — except New Zealand, and
  • countries where they have spent 12 months or more in over the last 10 years — even if those 12 months were not all in one stay.

Police certificates must show any criminal records you have had at any time in any of these countries — not only in the last 10 years.

Your partner does not need to provide a New Zealand police certificate — we can arrange this for them.

Your partner will not meet our character requirements if they have any convictions for or sexual offences. 

If they do not meet our character requirements, we will consider whether they are eligible for a character waiver.

Character requirements for New Zealand visas

Health

You must be in good health. 

You must have a chest X-ray and a medical examination as proof of your good health.

You need to provide evidence of these with your application.

Who needs an X-ray or medical examination

Character

You must be of good character.

You must provide police certificates that are less than 6 months old when you apply, if you are aged 17 or older.

You must get police certificates from:

  • countries you are a citizen of, and
  • countries where you have spent 12 months or more in over the last 10 years — even if those 12 months were not all in one stay.

Police certificates must show any criminal records you have had at any time in any of these countries — not only in the last 10 years.

You do not need to provide police certificates if you provided them with an earlier visa application and they were issued in the last 24 months. 

If we ask for a new police certificate when processing your application, you will need to send us a new one.

If you have a criminal conviction, or are a security risk to New Zealand, we might not give you a visa.

Character requirements for New Zealand visas

If you provide a police certificate that is not in English, you must provide an . This includes police certificates that record no convictions.

Dependent children

To include dependent children in your residence application, you must be their parent or legal guardian, and your children must:

  • be aged 24 or younger
  • not have children of their own, if aged 18 or older
  • be financially dependent, if aged 21 to 24 — they must rely on an adult (their parent or other family member) for financial support
  • be single — if they are living with a partner, they are not considered to be single, even if they have been living with their partner for less than a year
  • provide proof of their identity
  • meet the requirements for good health and good character.

Relationship with your children

You must provide documents that prove you are the parent or legal guardian of your children. These can include:

  • adoption papers
  • household registration documents
  • any other documents that confirm your relationship with them.

If you had a customary adoption, you will need to provide a written declaration stating you have adopted the children and the date and country the adoption took place. We may ask the children's biological parents to confirm the adoption.

Note

If you are a New Zealand resident visa and you could have included your dependent children in your residence application but you did not, we may ask you to explain the reason for this.

Custody of children aged 15 or younger

If your children are aged 15 or younger, we will ask for evidence that they can legally leave their home country.

If you are separated or divorced, you will need to provide legal documents that show:

  • you have the sole right to decide where your children live
  • you have the right to remove your children from their home country, or
  • you have legal custody of the children and your children's other parent agrees they can move to New Zealand if the children get resident visas.

If your children's other parent has died, you must provide their death certificate.

Note

If applying on paper, you must provide an original or a certified copy of your evidence.

If you have legal custody of your children and it is not possible to get legal documents to confirm this right, we will assess your right to remove the children on a case-by-case basis.

Dependent children aged 21 to 24 

Children aged 21 to 24 are only considered dependent if they are financially dependent, meaning they rely on an adult for financial support.

When deciding if your children are financially dependent, we look at whether they are:

  • working, full-time or part-time, and for how long
  • able to support themselves
  • living with a family member and how much they are supported
  • studying, full-time or part-time.

We may ask for proof that your children are financially dependent.

You can provide the original documents to prevent delays with processing.

When you apply

When you apply, you will need to provide:

  • a copy of your passport or — if you apply on paper, you can provide a , but it can prevent delays if you provide the original
  • 1 acceptable photo if you apply online, or 2 photos if you apply on paper
  • your
  • police certificates, if required
  • evidence of a chest X-ray
  • evidence of a medical examination
  • proof that your partner is a New Zealand citizen or resident
  • proof that your partner lives in New Zealand, if they are an Australian citizen or Australian permanent resident
  • documents to show you are in a with your partner
  • a Partnership Support Form for Residence, completed by your partner
  • documents to show your relationship to your dependent children, proof of their identity and acceptable photos, if you are including them
  • legal documents to show custody of your child, if required
  • translated versions of all your documents if they are not in English.

After you apply

After you apply, we may contact you and ask for:

  • evidence of a medical examination or chest X-ray if you have not already provided these
  • police certificates as proof of your good character
  • proof that your children are financially dependent.

    Get documents translated

    For your application you must provide:

    • certified English translations of any documents that are not in English
    • scanned copies of the original documents.

    Documents must be translated by someone who meets our requirements for providing English translations.

    If you need a new passport, allow yourself enough time to get it.

    When you apply, make sure you enter your identity details exactly as they appear on your passport or certificate of identity.

    Make sure your photos are acceptable for a New Zealand visa.

    Organise proof for your partner and dependent children

    Collect information to show your relationship with your partner and proof of their identity and immigration status.

    Ask your partner for their completed and signed 'Partnership Support Form for Residence' with their supporting documents.

    If you are including dependent children in your application, get documents that show your relationship to your children and proof of their identity.

    You will need to book your appointment for a chest X-ray and medical examination

    To complete your application, you will need to provide the:

    • reference code from the clinic submitting your health information
    • name of the clinic submitting your health information, if there is no eMedical reference code, or
    • medical certificate, chest X-ray certificate, or both if the clinic gave these to you.

    Evidence of a chest X-ray or medical examination must be less than 3 months old when we receive them. Allow yourself enough time to get these.

    If you are already in New Zealand, you must have a valid visa. If your current temporary visa is going to expire while you are waiting for our decision, we will normally issue you an interim visa to let you stay in New Zealand lawfully.

How to pay and submit

When you get your visa

You must come to New Zealand within 12 months of the date your visa is issued, if you applied for your visa outside of New Zealand.

When you arrive

You must apply for permission to enter New Zealand. You do this by completing a New Zealand Traveller Declaration (NZTD) form.

You can start your digital declaration any time, but the earliest you can submit it is 24 hours before starting your travel to New Zealand.

A paper declaration form is available for travellers who cannot complete it online.

Arriving in New Zealand

Alert

You can be refused entry permission if you:

  • do not meet our character requirements
  • have had a change in circumstances since we issued your visa
  • refuse to let us take your photo, fingerprints or an iris scan.

While you are in New Zealand

Your visa conditions are recorded in your eVisa.

Your resident visa allows you to live, work and study in New Zealand indefinitely.

Travel

With a Partner of a New Zealander Resident Visa, you can travel in and out of New Zealand as many times as you like until your travel conditions expire.

Your travel conditions expire 2 years from:

  • the date you first arrive in New Zealand as a resident
  • the date your visa is issued, if you are already in New Zealand.

To travel after that, you need to:

  • get a Permanent Resident Visa, or
  • extend your travel conditions, which would let you return to New Zealand at a later date.

With a Permanent Resident Visa, you can travel in and out of New Zealand indefinitely, as long as you keep your visa in a valid passport.

If your passport expires, you must apply to transfer your visa to a new passport before you can travel.

You can work in any role for any employer in New Zealand.

Study

You can study anywhere in New Zealand for any length of time.

After you have had a Partner of a New Zealander Resident Visa for 2 years in a row, you can apply for a Permanent Resident Visa. 

With a Permanent Resident Visa, you can travel in and out of New Zealand indefinitely, as long as you keep your visa in a valid passport.
