Employer evidence for an Agreement to Recruit

If you are a Recognised Seasonal Employer (RSE) who is applying for an Agreement to Recruit (ATR) you must supply evidence to help us process your application.

As a (RSE) of or workers, you need to send the following evidence with your Agreement to Recruit (ATR) application.

Evidence of agreements and contracts with third parties

You must supply:

  • a copy of the employment agreement you will offer overseas workers showing the required information
  • copies of contracts for service you hold with third parties — if required in your application.

Minimum requirements for RSE worker employment agreements

Evidence of pay deduction

You must supply evidence that the worker's deductions:

  • comply with relevant New Zealand employment legislation
  • are for a specified purpose and for actual, reasonable, verifiable expenses
  • are no more than those from New Zealanders (in comparable circumstances).

Agreeing to voluntary pay deductions when you work on an RSE visa

Evidence of accommodation

You must supply evidence showing:

  • you own the accommodation — if it is in Hawke's Bay or the Bay of Plenty it needs to show the purchase date, or
  • the accommodation meets requirements if you do not own it, for example a rental agreement or similar, booking information, or council consent information (if it was purpose-built for horticulture and viticulture workers).

Evidence you agree to pay repatriation costs

You must include a signed letter of guarantee that states you agree to:

  • pay a fixed amount of repatriation costs to send a worker who breaks their visa conditions home
  • pay a fixed amount towards repatriating any worker who breaks their visa conditions — note, the repatriation costs can be anything up to NZD $3,000 for each worker (this includes any living and accommodation costs).

You must tell us when your RSE worker:

  • is suspended or dismissed
  • breaks their visa conditions.
