E2.45 Eligibility for visa pending liability for deportation

- A person liable for deportation may not apply for a visa if he or she is unlawfully in New Zealand.
- A person liable for deportation (who is not unlawfully in New Zealand) may only apply for a visa of the same class and type that he or she held before becoming liable for deportation.
- The Minister may in his or her absolute discretion, grant a temporary visa to a person prohibited from applying for one under E2.45 (a) and (b).
- The Minister or an immigration officer may, in his or her absolute discretion, grant a visa of a different class or type to a person to whom E2.45 (b) applies.
