E2.15 Who may not apply for a temporary visa to be in New Zealand

- No person who is unlawfully in New Zealand may apply for a visa and, where any such person purports to apply for a visa, it is a matter for the absolute discretion of the Minister. (see E8.1)
- A limited visa holder, interim visa holder, or transit visa holder may not apply for a temporary visa; and
- A person liable for deportation may only apply:
- for a visa of the same class and type that he or she held before becoming liable for deportation; and
- if he or she is not unlawfully in New Zealand.
The Minister, in his or her absolute discretion, may grant a temporary visa to a person prohibited from applying for a temporary visa under E2.15(b) or (c).
