C3.5 Who may make a claim for refugee or protection status

  1. People, other than those to whom C3.10 applies, who are in New Zealand either lawfully or unlawfully may make a claim for refugee or protection status.
  2. A resident or permanent resident who has been served with a deportation liability notice or is named in an Order in Council certifying the person constitutes a threat or risk to security may make a claim for refugee or protection status.
