C3.1 Whose claim for refugee or protection status may not be accepted

See also Immigration Act 2009 ss 132, 163

  1. A refugee and protection officer must not consider a claim by a person who is:
    1. a New Zealand citizen; or
    2. a resident or permanent resident, unless the person has been served with a deportation liability notice or is named in an Order of Council which certifies that the person constitutes a threat or risk to security.
  2. Nothing in C3.1 affects the power of a refugee and protection officer to re-open a claim for further consideration as to cessation or cancellation.
