C6.10 Time limit for detained claimant to confirm claim

  1. If a detained person indicates that they wish to claim refugee status, they should, without delay and preferably within two calendar days, confirm their claim in writing in the prescribed manner (see C4.20).
  2. This period of time may be shorter if the person is making a subsequent claim for refugee status (see C6.20) or if the person is to be interviewed without a written statement.
  3. In setting a time limit for the detained person to confirm their claim, a refugee status officer must ensure that the person is given reasonable opportunity to exercise their right under regulation 4 of the Immigration (Refugee Processing) Regulations 1999 and (if applicable) section 140(4) of the Immigration Act 1987 (see C6.5) to contact:
    1. a lawyer; and/or
    2. a representative of the UNHCR; and/or
    3. a parent, guardian or responsible adult (if applicable).
