C6.20 Subsequent claims by detained people

  1. If a detained person makes a subsequent claim for refugee status, the refugee status officer conducting the interview should first ascertain whether, since the final determination of the previous claim, circumstances in the claimant's home country have changed to such an extent that the subsequent claim is based on significantly different grounds from the previous claim.
  2. If the officer considers that circumstances have not changed sufficiently, they should conclude the interview at that point.
  3. If the officer considers that circumstances have so changed, they should continue the interview to enable the claimant to present their case in full.

Effective 01/10/1999
