H8.15 Determining an application for a 2022 Special Ukraine Visa

  1. A 2022 Special Ukraine Visa may be granted to a Nominated Family Member if an immigration officer is satisfied that they:
    1. meet health requirements outlined in (e) below; and
    2. character requirements for temporary entry (A5); and
    3. are sponsored by an acceptable New Zealand sponsor (H8.20); and
    4. has been nominated by a Supporting Family Member (H8.17); and
    5. was ordinarily resident in Ukraine as at January 2022; and
    6. meets family relationship requirements; and
    7. both they and their New Zealand sponsor are listed in the Invitation to Apply letter; and
    8. are in New Zealand and hold a 2022 Special Ukraine Visa, or had made an Expression of Interest under the 2022 Special Ukraine Visa instructions on or before 15 March 2024 where the Expression of Interest was yet to be determined or issued an invitation to apply.
  2. A 2022 Special Ukraine Visa may be granted to a partner of a Nominated Family Member if an immigration officer is satisfied that:
    1. the partner and the Nominated Family Member meet partnership requirements outlined at E4.1.20; and
    2. the partner meets health requirements outlined in (e) below; and
    3. the partner meets character requirements for temporary entry (A5); and
    4. the Nominated Family Member is granted a 2022 Special Ukraine Visa; and
    5. the partner was listed on the Nominated Family Member’s Invitation to Apply letter.
  3. A 2022 Special Ukraine Visa may be granted to a dependent child of a Nominated Family Member if an immigration officer is satisfied that:
    1. the dependent child meets the definition of a dependent child outlined at R2.1.30 and custody of children under the age of 16 years requirements at E4.1.15 (if applicable); and
    2. the dependent child meets health requirements outlined in (e) below; and
    3. the dependent child meets character requirements for temporary entry (A5); and
    4. the Nominated Family Member is granted a 2022 Special Ukraine Visa; and
    5. the dependent child was listed on Nominated Family Member’s Invitation to Apply letter.
  4. Despite E7.1 and E7.10, applicants for the 2022 Special Ukraine Visa do not need to meet ‘bona fide applicant’ requirements outlined in E5.10.
  5. Despite the requirements outlined in A4.15, an applicant for a 2022 Special Ukraine Visa will be considered to have an acceptable standard of health unless they:
    1. require dialysis treatment, or an Immigration New Zealand medical assessor has indicated that they will require such treatment within a period of five years from the date of the medical assessment; or
    2. have severe haemophilia; or
    3. have a physical, intellectual, cognitive and/or sensory incapacity that requires full time care, including care in the community; or
    4. currently have tuberculosis (TB) (any form including pulmonary and non-pulmonary TB, MultidrugResistant (MDR)-TB and Extensively Drug-Resistant (XDR)-TB) and have not completed full treatment for TB as outlined in the New Zealand Guidelines for TB Treatment; or
    5. have had a history, diagnostic findings or treatment for MDR-TB or XDR-TB, unless they have been cleared by a New Zealand Respiratory or Infectious Diseases specialist upon review of their file or review of the applicant as outlined in the New Zealand Guidelines for TB.

      Note: Applicants for a 2022 Special Ukraine Visa do not need to provide a medical certificate, chest x-ray, or police certificates.

  6. Applications under these instructions will be given priority processing.
