D7.70 Transitional provisions relating to offences

See also Immigration Act s 455

  1. A person commits an offence against section 343(1)(d) of the Immigration Act 2009 whether the condition concerned was:
    1. imposed (or deemed to be imposed) under the Immigration Act 2009; or
    2. imposed under the Immigration Act 1987 (whether as a requirement or a condition).
  2. A person commits an offence against section 344(a) of the Immigration Act 2009 whether the document or information was required:
    1. under the Immigration Act 2009; or
    2. under the Immigration Act 1987, if the officer could lawfully require the document or information under that Act.
