Y4.32 Release on conditions

Immigration Act 1987 ss 128A, 128AB, 128AC, 128AD

  1. Persons detained under Section 128 may be released on conditions on application of an Immigration Officer or the person concerned.
  2. Any application for the release on conditions must be made under oath to a district court judge and, on application, the district court judge may order the person's conditional release.
