W4.10 Considering requests for approval in principle (26/07/1999)

The NZIS must determine whether the employer has made genuine attempts to find suitably qualified and experienced New Zealand citizens or residents by means of the following process:

  1. The NZIS first examines the information provided by the employer to decide whether:
    1. the attempts to recruit New Zealanders are genuine, and
    2. any suitably qualified and experienced New Zealanders are available for the jobs in question.

      Note: availability includes willingness to do the job in question.

  2. In deciding whether the attempts to recruit New Zealanders were genuine, the NZIS may consider, amongst other things, any or all of the following factors:
    • whether the advertisements accurately stated the qualifications and experience required and the nature of the jobs;
    • whether the requirements for national advertising have been met (see W4.5.1);
    • the pay and conditions offered.
  3. In deciding whether the recruitment attempts attracted applications from any New Zealanders who were suitably qualified and experienced and available to do the job, the NZIS must consider details of New Zealand applicants provided by the employer and the reasons given for not appointing the New Zealand applicants.
  4. If necessary, the NZIS may inquire independently from within the fishing industry or from Work and Income New Zealand or from any other source not already relied on by the employer, as to whether suitably qualified and experienced New Zealanders are available for the jobs in question.
  5. If the NZIS is satisfied that there are no suitably qualified and experienced New Zealanders available for the jobs in question, it gives approval in principle to the employer to recruit a stated number of crew members overseas for the named CFF vessel(s).
