W4.5 Requests for approval in principle (26/07/1999)
  1. The general objective of work permit policy applies to requests for approval in principle: that is, employment opportunities for New Zealand citizens and residents should be protected.
  2. The employer must sufficiently show that there are no suitably qualified and experienced New Zealand citizens or residents (or not enough of them) available to crew the CFF vessel(s) for the particular period.
  3. To meet the requirement in paragraph (b), the employer must provide evidence that:
    1. the positions were advertised nationally (see W4.5.1 below) in the previous 6 months, and
    2. either there were no New Zealand applicants, or any New Zealand applicants not appointed were not suitably qualified and experienced.
  4. The employer must provide details of all New Zealand applicants whether or not they were appointed, and also reasons for the respective decisions.
  5. The employer may provide additional information to support the case for recruiting overseas crew, such as:
    • evidence that Work and Income New Zealand was unable to provide suitably qualified and experienced New Zealand citizen or resident candidates, or
    • evidence from others in the fishing industry about the current state of that part of the labour market.

W4.5.1 Definition of 'positions advertised nationally'

Positions are advertised nationally if:

  1. they are advertised:
    1. by the particular employer requesting approval in principle, or
    2. as part of 'generic' advertising for such positions on behalf of one or more employers; and
  2. they are advertised in The New Zealand Herald, The Dominion, The Press, The Nelson Mail, and The Otago Daily Times; and
  3. the advertisements contain information on:
    1. the number of positions available, and
    2. the nature of each position, and
    3. how long the positions last, and
    4. the qualifications and experience required by each crew member being recruited.
