A7.5 Who may make a request under the Privacy Act 1993

Privacy Act 1993 ss 6, 34

  1. Requests regarding personal information by the individual concerned, under principle 6 (access) and principle 7 (correction), may only be made by a person who is:
    1. a New Zealand citizen, or
    2. a permanent resident of New Zealand, or
    3. an individual who is currently in New Zealand.
  2. Individuals may authorise an agent or an adviser to receive the information on their behalf.
  3. Requests by agents or advisers for information about their clients who are not New Zealand citizens/permanent residents or not in New Zealand, are dealt with under section 12 of the Official Information Act 1982.
