WA2.55 Suspending and revoking employer accreditation
- An immigration officer may suspend an employer’s accreditation for up to 3 months at a time or until there is an outcome of the verification, compliance or investigation activities, whichever occurs first, where there is an active verification, compliance or investigation activities or case pending for potential non-compliance with the requirements of employer accreditation set out in these instructions taking into account the factors as set out at WA2.10.10(k).
- An immigration officer must suspend an employer’s accreditation where there is a prosecution underway for potential non-compliance with WA2.10.10(a) to (j). Suspension will remain in place until the outcome of the prosecution.
- Any decision to suspend employer accreditation must be approved by an Immigration Manager.
- Employer accreditation remains with the legal entity that was granted accreditation. Where an accredited employer merges or amalgamates with a non-accredited employer, accreditation will be deemed to be revoked where that amalgamation or merger results in the final entity being a new entity, or the existing non-accredited entity.
- An immigration officer will revoke an employer’s accreditation where:
- as a result of verification, an immigration officer determines that the employer does not meet the requirements of employer accreditation set out in these instructions; or
- as a result of verification an employer refuses INZ entry to conduct a site visit without reasonable justification, and this results in the immigration officer not being satisfied that the employer meets the accreditation requirements set out in these instructions; or
- an employer does not provide information to INZ within 10 working days, without reasonable justification, where that information has been requested as part of verification or compliance activities being carried out by an immigration officer.
- Any decision to revoke employer accreditation must be approved by an INZ Head of Operations.
- Employers that have their employer accreditation suspended or revoked will be notified and informed of the reasons in writing.
