BD8 Grant of one further Business Investor Work Visa (‘Renewal’)

1. One further Business Investor work visa (Renewal) may be granted for up to two years where the Business Investor work visa holder requires a further work visa to meet the requirements to be granted a Business Investor resident visa because:
   1. the business has not been operating for three years (see BI2.5); or
   2. the visa holder has not created ongoing, full time equivalent employment of at least 12 months duration for one additional New Zealand citizen or resident (see BD9.40).
2. An application must be made using the approved form and the prescribed fee and immigration levy paid.
3. The further Business Investor work visa will be granted only where a business immigration specialist is satisfied that:
   1. the business continues to employ at least five people in full time equivalent positions; and
   2. the business complies with specific immigration, employment and business standards (see BD9.10) and
   3. the business is solvent (see BD9.65) and complies with all financial, tax and legal obligations; and
   4. the principal applicant retains at least the same proportion of ownership of the business which was approved under the Business Investor work visa instructions; and
   5. the principal applicant has spent the majority of their time, when in New Zealand, operating the business; and
   6. the principal applicant continues to meet fit and proper person requirements (see BM1); and
   7. the principal applicant can credibly meet, within the duration of the further visa, the requirements for the grant of a Business Investor resident visa by operating the business for three years (or 12 months if business was purchased for at least NZ $2 million (see BI2.10) and create ongoing, full time equivalent employment for one additional New Zealand citizen or resident; and
   8. the principal applicant and any partner or dependent children included in the application meet health and character requirements for residence (see A4 and A5).
