U6.20 Variations to work visas and visitor visas to allow study (29/11/2010)

  1. Holders of work or visitor visas must apply for a variation of conditions to their current visa if:
    1. they wish to undertake a course of study longer than 3 months (see also U7.20.1); and
    2. it is inappropriate for some other reason to apply for a student visa.
  2. Immigration officers with Schedule 3 delegations and above may give a special direction varying the conditions of the current visa to allow study, provided that they sight evidence that the applicant has:
    1. an offer of a place at an education provider; or
    2. a signed training agreement with an Industry Training Organisation; and
    3. paid the course fees or is exempt from having to pay them.
  3. Holders of visitor visas granted under the special category V3.100 may only be given a special direction varying conditions to allow part-time study.
