RA4 Who is deemed to hold a residence class visa

See also Immigration Act 2009 ss 75, 415, Schedule 5

A person is deemed to hold a residence class visa if they:

  1. held a returning resident’s visa issued under the Immigration Act 1987 (RA4.1 and RA4.5); or
  2. held a residence permit granted under the Immigration Act 1987 (RA4.10); or
  3. were considered to hold a residence permit under the Immigration Act 1987 (see RA4.10.1); or
  4. were exempt under the Immigration Regulations 1999 from the need to hold a residence permit in New Zealand (RA4.10); or
  5. held New Zealand citizenship and renounced or were deprived of their citizenship (RA4.10).
