C2.15 Legal aid for refugees or refugee status claimants

Legal services Act 1991 ss 19(1)(ja) and (jb), 19(3)

  1. Refugees or refugee status claimants are eligible for civil legal aid on or after 1 October 1999 in relation to:
    1. processing any claim for refugee status made on or after 1 April 1999; and
    2. processing any other matter arising under C3.10(a) and (b) that first arose on or after 1 April 1999; and
    3. any judicial review proceedings in relation to matters arising under C2.15(a)(i) or (ii); and
    4. any application for a review by the Inspector-General of Intelligence and Security of a decision of the Director of Security to make a security risk certificate under section 114D of the Immigration Act 1987.
  2. Refugees or refugee status claimants are eligible for civil legal aid in relation to the matters in C2.15(a) whether they are in New Zealand lawfully or unlawfully.
  3. Refugees and refugee status claimants who wish to apply for civil legal aid in relation to the matters in C2.15(a) should be advised to contact a lawyer.
