WG3.5 Determining requests to employ non New Zealand citizen or resident workers (29/04/2002)

  1. Visa and immigration officers must not give an approval in principle to employ a non New Zealand citizen or resident worker unless they have first conducted a labour market test (see WG3.10) and are satisfied:
    1. that the employer has genuinely attempted to recruit suitable New Zealand workers, and
    2. that there are no New Zealand citizens or residents available to do the work offered, and
    3. that the job offer is both genuine and sustainable for the duration of the proposed employment contract, and
    4. that the employer will comply with the relevant employment and immigration law (see W2.10.5).
