U6.25 Interim temporary permits for student permit applicants

Immigration Act 1987 s 30(1)

Temporary permit holders may be granted further temporary permits in the following situations:

1. If an applicant for a student permit was not required to provide evidence of health and character before arriving in New Zealand, and must now do so (see E6.1 and E6.5), but is unable to while their existing permit is current, officers with Schedule 3 delegations and above have discretion to grant a temporary permit (or issue a temporary visa) for an interim period of a maximum of 3 months, provided that the applicant is:
   1. in New Zealand, and
   2. currently exempt from having to hold a permit, or holds another type of temporary permit.
2. When the student permit requirements in paragraph (a) above have been met, a further permit may be granted for the full period requested without the applicant having to make a further application.
3. If a student permit holder has applied for residence while lawfully in New Zealand, immigration officers may grant a further student permit for 3 months provided that:
   1. a final decision on the residence application is unlikely before the current student permit expires, and
   2. the mandatory requirements for a further permit are met.
