C5.5 Information on claimant's rights

Immigration (Refugee Processing) Regulations 1999 reg 4

Once a refugee status claim has been assigned to a refugee status officer for processing, that officer must inform the claimant of the following rights:

  1. the right to contact a representative of the UNHCR, together with information on how to exercise that right; and
  2. the right to contact a lawyer; and
  3. the right to have an independent interpreter engaged by Immigration New Zealand present at any interview of the claimant by a refugee status officer.

C5.5.1 Other information to be provided to claimants

Immigration (Refugee Processing) Regulations 1999 reg 5

Refugee status officers must inform claimants of the procedure for determining their claim, including the following matters:

  1. how contact will be maintained; and
  2. possible requests for further information;
  3. the claimant's right to provide further information up to the time that the claim is actually determined; and
  4. the availability of an independent interpreter, if appropriate; and
  5. the decision-making process, including information about the process for scheduling an interview; and
  6. the right of appeal to the RSAA if the claim is unsuccessful; and
  7. the right to an interview before the RSAA if the claimant has not been interviewed by a refugee status officer for the purpose of determining the claim.
