G2.33 Issue of work visa or permit to principal applicants (29/04/2002)

Note: This policy ceased to be effective from 01 July 2003.

  1. Principal applicants who:
    1. have a points allocation which is within 5 points of the General Skills category passmark for the week in which their residence application was made, and
    2. have not been awarded points for an offer of employment, and
    3. have met health, character (see A4 and A5) and English language requirements (see G6),

    may apply under Temporary Entry policy for a multiple entry work visa or work permit allowing a maximum stay in New Zealand of up to 6 months to enable them to seek an offer of employment in New Zealand in terms of G4.15 “Offer of Employment” or G5.25 "Non-relevant offer of employment" (see WR4).

    Note: Principal applicants who require points for work experience in order to obtain a point score within 5 points of the applicable General Skills category passmark, must demonstrate that this work experience is relevant to the qualification for which points have been awarded (see G4.1(d) and G4.1.5).

  2. Application for the work visa or work permit must be made within one month of the date of the letter from the NZIS advising that they are eligible to apply for the work visa or work permit.
  3. Principal applicants:
    1. who do not apply under Temporary Entry policy for the work visa or permit within the period specified in b. above, or
    2. whose application for a work visa or work permit under WR4 is declined,

    will have their application for residence under the General Skills category declined unless they have provided further evidence which results in the allocation of sufficient points to meet the passmark for the week in which their residence application was made.

  4. Principal applicants who are issued with a work visa or granted a work permit under Temporary Entry policy for the purpose of seeking an offer of employment in New Zealand will have their residence application deferred:
    1. for a period of 9 months from the date of the letter from the NZIS advising that they are eligible to apply for the work visa, if applying outside New Zealand, or
    2. for a period of 7 months from the date of the letter from the NZIS advising that they are eligible to apply for the work permit, if applying in New Zealand.
  5. If evidence of an acceptable offer of employment is provided to the NZIS before the expiry of the deferral period, the application will continue to be assessed.
  6. Points will only be awarded for an offer of employment if the requirements for offers of employment as set out in residence policy are met (see G4.15 to G4.30 or G5.25 to G5.25.20).
  7. If, upon expiry of the deferral period:
    1. no evidence of an offer of employment has been provided to the NZIS, or
    2. the offer of employment is awarded insufficient points (as a non-relevant offer of employment, see G5.25) to increase the applicant's overall point score to the level of the passmark for the week in which their residence application was made; and
    3. no further evidence has been provided to the NZIS which results in the allocation of sufficient points to meet the passmark for the week in which their residence application was made;

    the application for residence under the General Skills category must be declined.
