A15.4 Instruments of Delegation 2005 (25/05/2005)

Delegation of Powers to Department of Labour Workforce - Immigration Services

I, PAUL DESMOND SWAIN, MINISTER OF IMMIGRATION, acting pursuant to section 131(1) of the Immigration Act 1987, hereby:

  1. delegate to every immigration officer who is the holder (or is acting as the holder) of any of the offices or positions listed below, or whose name and/or position is listed in Appendix 1 to this instrument:
    1. the powers delegated under Schedule 1 in the Instrument of Delegation signed by the Minister of Immigration on 30 September 1999; and
    2. the powers delegated in the Instrument of Delegation signed by the Minister of Immigration on 19 February 2004; and
    3. the powers delegated in the Instrument of Delegation signed by the Minister of Immigration on 8 April 2004;
  2. delegate to every immigration officer whose name and/or position is listed in Appendix 2 to this instrument:
    1. the powers delegated under Schedule 2 in the Instrument of Delegation signed by the Minister of Immigration on 30 September 1999; and
    2. the powers delegated in the Instrument of Delegation signed by the Minister of Immigration on 19 February 2004; and
    3. the powers delegated in the Instrument of Delegation signed by the Minister of Immigration on 8 April 2004;
  3. delegate to every immigration officer whose name and/or position is listed in Appendix 3 to this instrument, the powers delegated under Schedule 3 in the Instrument of Delegation signed by the Minister of Immigration on 30 September 1999;
  4. delegate to every immigration officer whose name and/or position is listed in Appendix 4 to this instrument, the powers delegated under Schedule 4 in the Instrument of Delegation signed by the Minister of Immigration on 30 September 1999;
  5. delegate to every immigration officer who is an immigration officer by virtue of being a customs officer designated by the Secretary of Labour as an immigration officer, whether individually or by class or position, the powers delegated under Schedule 5 in the Instrument of Delegation signed by the Minister of Immigration on 30 September 1999.

Level 1

  1. Persons who are grade 2511.08 or Band 4 on the New Zealand Immigration Service pay structure as defined in the current Department of Labour Collective Employment Agreement or, in the situation of the Department of Labour Collective Employment Agreement having expired, the Department of Labour Collective Employment Agreement which most recently applied.
  2. Persons who are Band 4 of the New Zealand Immigration Service pay structure as recorded in the New Zealand Immigration Service payroll.
  3. Persons who hold the title of Branch Manager or Manager as of the date of signature of the Instrument of Delegation to which this schedule is appended.
  4. Persons who hold the title of Technical Advisor.
  5. The following persons as specified:

A15.4.10 APPENDIX 2 COMPETENCY SCHEDULE OF IMMIGRATION OFFICERS EMPLOYED BY THE DEPARTMENT OF LABOUR

Level 2

  1. Persons who are grade 2511.04 or Band 3 on the New Zealand Immigration Service pay structure as defined in the current Department of Labour Collective Employment Agreement or, in the situation of the Department of Labour Collective Employment Agreement having expired, the Department of Labour Collective Employment Agreement which most recently applied.
  2. Persons who are Band 3 of the New Zealand Immigration Service pay structure as recorded in the New Zealand Immigration Service payroll.
  3. The following persons as specified:

Level 3

  1. Persons who are grade 2511.02 or Band 2 on the New Zealand Immigration Service pay structure as defined in the current Department of Labour Collective Employment Agreement or, in the situation of the Department of Labour Collective Employment Agreement having expired, the Department of Labour Collective Employment Agreement which most recently applied.
  2. Persons who are Band 2 of the New Zealand Immigration Service pay structure as recorded in the New Zealand Immigration Service payroll.

A15.4.20 APPENDIX 4 COMPETENCY SCHEDULE OF IMMIGRATION OFFICERS EMPLOYED BY THE DEPARTMENT OF LABOUR

Level 4

  1. Persons who are grade 2511.01 or Band 2 on the New Zealand Immigration Service pay structure as defined in the current Department of Labour Collective Employment Agreement or, in the situation of the Department of Labour Collective Employment Agreement having expired, the Department of Labour Collective Employment Agreement which most recently applied.
  2. Persons who are Band 2 of the New Zealand Immigration Service pay structure as recorded in the New Zealand Immigration Service payroll.
