E4.55 Requirements for lodging an application for a temporary permit while in New Zealand

Applications for a temporary permit made by persons in New Zealand must meet the mandatory lodgement requirements set out:

  1. either in E4.55.1 below for applications requiring lodgement on an approved form, or
  2. in E4.55.5 below if the type of temporary permit being applied for may be applied for otherwise than on an approved form.

E4.55.1 Mandatory requirements for applications lodged on an approved form

For the purposes of temporary permit policy for applications lodged on an approved form, mandatory requirements means that applications by a person who is already in New Zealand must be made on the application form relevant to the type of permit required, which must be completed in full and submitted to an immigration officer at a NZIS office in New Zealand, together with:

  1. the applicant's valid passport or travel document, or if this is unavailable, evidence of the applicant's current permit or exempt status; and
  2. the appropriate fee (if any); and
  3. evidence of funds for maintenance in New Zealand or evidence of sponsorship; and
  4. travel tickets or evidence of onward travel arrangements; and
  5. any other information, evidence and submissions the applicant considers show that they should be granted with a temporary permit.

E4.55.5 Mandatory requirements for applications lodged otherwise than on an approved form

An immigration officer may consider a request that an application be made otherwise than on an approved form, and where agreement to that request is given the applicant must supply the following:

  1. For the purposes of temporary permit policy, mandatory requirements for applications lodged otherwise than on an approved form includes:
    1. their name, and
    2. their date of birth, and
    3. details of their passport or other travel document, including country of citizenship, and
    4. details of any current permit (if any) held by them, and
    5. details of the type of permit applied for, and
    6. details of their funds for maintenance while in New Zealand, or details of sponsorship, and
    7. details of their travel tickets or evidence of onward travel arrangements from New Zealand, and
    8. any other information, evidence and submissions they consider show that they should be issued with the temporary permit applied for.
  2. the applicant must also complete their application by:
    1. acknowledging that the details provided in support of their application are true and correct to the best of their knowledge, and
    2. agreeing that if their circumstances change before a permit is granted they will notify an immigration officer of that change in circumstances, and
    3. paying the prescribed fee for the type of permit applied for, or arranging for the payment of that fee in a manner satisfactory to the immigration officer.

E4.55.10 Limitations on applications that may be lodged otherwise than on an approved form

Immigration Regulations 1999 reg 3A

  1. The Immigration Regulations 1999 allow for applications to be made otherwise than on the approved form. Applications which may be made in this form are limited to:
    1. those persons wishing to apply for a further visitors’ permit; and
    2. those visitors’ permit applications where in an immigration officers view, the decision to grant or refuse a permit is straightforward and any verification requirements are minor in nature.
  2. Accordingly requests for further temporary permits other than those specified in (a.) above will be refused.

Before determining the application, the immigration officer processing it may require the applicant:

  1. to produce any other photographs, documents and information the officer thinks necessary; or
  2. in the case of an applicant for a work permit or a student permit, to undergo a medical examination; or
  3. to appear for an interview.

E4.55.20 Applicant to specify address for service

Immigration Act 1987 s 37(2)

Everyone who applies for a temporary permit must give in the application an address in New Zealand at which they may be contacted about the application or about any permit that may be granted as a result of the application.
