U6.20 Variations to work permits and visitor’s permits to allow study

  1. Holders of work or visitor’s permits must apply for a variation of conditions to their current permit if:
    1. they wish to undertake a course of study longer than 3 months; and
    2. it is inappropriate for some other reason to apply for a student permit.
  2. Immigration officers with Schedule 3 delegations and above may give a special direction varying the conditions of the current permit to allow study, provided that they sight evidence that the applicant has:
    1. an offer of a place at an education provider, or
    2. a signed training agreement with an Industry Training Organisation, and
    3. paid the course fees or is exempt from having to pay them.
  3. Holders of visitor’s permits granted under the special category V3.100 Guardians accompanying students to New Zealand may only be given a special direction varying conditions to allow part time study.
