Will efforts to regain lawful status by a person on expired visa be recognised by immigration?

If a person’s application is declined and they make considerable attempts to obtain a visa to remain lawful in New Zealand, will their efforts be recognised by immigration?

If a person does not have valid visa, they are obligated to leave New Zealand. An Immigration Officer will only decline a visa application following a thorough assessment, so there will be sound reason/s for this decision.

An officer processing a request (under Section 61) from a person without a valid visa will look into their situation and consider whether the original decision should (or can) be overturned.

In some cases, such a person is given an opportunity to temporarily stay in NZ, however, you must understand that Section 61 is a tool of immigration and the person who has lodged such a request is not entitled to any visa.
