Newborn children of residence class visa holders

Children born outside New Zealand to applicants who hold residence class visas but have not yet travelled to New Zealand on those visas, may be included in their parents’ applications. Immigration instruction R5.70 allows a dependent child to be added to a residence application up until the parents’ enter New Zealand and activate their residence.

If the residence application has not been completed in AMS, the new born dependent child can be added to the application and processing can continue as normal.

However if the application has been completed, but the parents’ have not yet travelled to New Zealand and activated their residence, the dependent child cannot be added to the existing application. As AMS does not allow for this, the dependent child’s application should be raised as a ‘Residence Replace’ and linked to the parents’ original residence application and the visa label and conditions issued in line with the principle applicant of the original application.

Any subsequent applications for PRV/VOTC/SSRV by the dependent child should be assessed as if they were included in the original residence application.

As R5.70 refers to children born to ‘applicants’ i.e. any person included in the residence application, it does not make any difference if the principal applicant has already made their first entry to New Zealand but the secondary applicant has not.
