Cancelling temporary entry class visas

This advice provides clarification on who can cancel temporary entry class visas and in what circumstances.

When a temporary entry class visa can be cancelled

Section 66 of the Immigration Act 2009 as reflected in temporary entry instructions at E3.55 provides that temporary entry class visas can be cancelled when the holder is offshore and there is sufficient reason to do so. Some examples of when it might be appropriate to consider cancelling a temporary visa include but are not limited to:

  • when an Essential Skills work visa holder (multiple entry travel conditions) departs and we get advice from the employer that their employment has been terminated
  • when a Partnership work visa holder (multiple entry travel conditions) departs and partner writes to say the partnership has ended.

Who can cancel a temporary entry class visa?

The office that granted the visa is responsible for cancelling that same visa. In some circumstances Compliance can cancel a temporary entry class visa regardless of where it was granted. Please note this process is not a Border Operations function.

INZ’s Investigations and Compliance branch receives a number of cases where cancellation seems appropriate, and refers some of those cases to the office that granted the visa for cancellation.
