Variations of conditions and the notice period of existing employment

The following advice is best practice for approving applications for a variation of conditions where an applicant will work for a new employer, but must first complete the notice period of their existing employment.

Immigration instruction E3.25(e)(ii) allows immigration officers to specify a future date from which varied visa conditions will take effect. If an applicant applies for a variation of conditions, but their new visa conditions would prevent them completing the notice period, immigration officers should specify a future date in line with the notice period.

If an immigration officer decides that an applicant’s varied visa conditions will take effect from a future date, the approval letter and AMS notes must clearly state the date from which those varied visa conditions will take effect.
