Minimum Guaranteed Working Hours for Work Visa Applications

Officers who are assessing work visa applications should check the wording in the employment agreement to ensure the employer is offering full time work as defined in immigration instructions.

W2.2.10 Definition of 'full-time employment'

Unless otherwise specified, full-time employment is considered to be at least 30 hours of work per week for the purpose of all work instructions.

Some employment agreements contain clauses that allow the employer to alter an employees working hours to less than 30 hours per week so the employee is not guaranteed full time work.

The extract below is taken from an employment agreement that does not guarantee full time work and therefore does not satisfy instructions.

Status of Work: Fixed Term Full Time
Hours of Work: A typical work week is 45 in a week from 07.00 am to 16.30 Monday to Friday.

Where due to seasonal and/or environmental factors your normal hours of work on any given day are reduced you will only be paid for those hours in which you worked.

Where due to seasonal and/or environmental factors you are not required to work on what would otherwise be a normal working day for you, you will not receive payment for that day.
