Visa Label Conditions for employment in Canterbury and Labour Hire Companies

As of July 2015, immigration instructions were amended in respect of those granted a work visa for employment in the Canterbury region and for those employed by a labour hire company.  The change allowed them to work for any employer.  This was to support the objective of labour mobility and allow applicants to change employers without having to apply for a new work visa. 

However, an issue has been raised in regards to occupations where the employment agreement has a generic job title and could potentially be used across industries.

Example:
Employment Agreement  Customer Service Representative
Actual Job                   Service Station Attendant
ANZSCO                      Service Station Attendant 621611

If the applicant was issued a work visa as a ‘Customer Service Representative for any employer’ then they could obtain a job in any industry as the job title is very generic and could ‘fit’ any number of jobs.  This also allows the potential for abuse of the system.

In regards to the above example, the applicant’s work visa was assessed as per the positon details and in line with the relevant ANZSCO code.  The visa label conditions should reflect that.

For applications where the employment agreement provides a generic job title, then visa label conditions should include both job titles.  For the above example the label should read ‘….may only work as a Customer Service Representative (Service Station Attendant) for any employer in xxx region'
