Variation of Conditions fee waiver

As per instruction E3.25.1, conditions in temporary visas can be varied to allow individuals to work, study or vary conditions of their employment. This article clarifies when it is appropriate to waive the fee for a Variation of Conditions (VoC) application:

VoC application lodged at the same time as the substantive visa application or while the application is in process:

  • If an individual submits a work/visitor’s visa application, and then submits a VoC application while the work/visitor visa application is still being processed, a separate fee for the VOC should not be charged.
  • Example:
    When a temporary visa application includes a request for a VoC to study or work part-time, the VoC application fee should not be charged as a separate application. The VoC should be considered as part of the conditions on the work/visitor’s visa and covered by that visa application fee.

VoC application after the substantive visa or permit has been granted:

  • When a visa holder applies for a VOC after the substantive visa that they are seeking to vary has been granted, this is deemed a new application and a separate fee for a VoC application should be charged.
  • Example:
    If the work/visitor visa or permit holder applies for a VoC to enable them to study, then that would be deemed a new application and a separate fee for a VoC application should be charged.

Waiving the fee

When waiving a VoC application fee in the circumstances above, it will need to be waived as an administrative fee waiver (associated application) as per IAC 10-06.

Update processes and ensure that all processing staff are aware of when VoC fees should be waived.
