Parent Category residence conditions

Context:

This is to provide advice to branches around placing s49 conditions on the Parent Category resident visa labels.

Parent Category residence instructions state (F4.25) that in order to be granted residence under the Parent Category applicants must be sponsored by an adult child who agrees to meet the sponsorship undertakings (R4.10) for the first five years of the applicants’ stay in New Zealand. Immigration instructions at F4.50 have also been amended recently to clarify that sponsorship conditions are imposed under sections 49(1) and 55 of the Immigration Act 2009.

Action:

All branches granting residence under the Parent Category should be placing s49 conditions on the residence visa – the visa label should read “This visa is subject to conditions imposed under s49 of the Immigration Act 2009”.
