Dependent children of Essential Skills work visa applicants

Although a family of applicants apply individually for a Temporary Entry Class Visa their eligibility is interdependent.

Immigration instructions at WK1.15 Minimum income requirement for dependent children of Essential Skills work visa holders, requires Essential Skills work visa holders to meet a minimum income threshold if they wish to support their dependent child’s student or visitor visa application. In such cases, both the parent/s and dependent child’s visas must be issued with the condition that the minimum income threshold must be maintained for the duration of the dependent child’s visa. If the threshold is not maintained then the parent/s and child may be liable for deportation.

Staff must ensure that Essential Skills work visa applicants with dependent children are able to meet the minimum income threshold, and that this condition is stated on the parent/s and child/ren’s visa labels. Applicants who are not able to meet this threshold should be given the opportunity to comment before a decision is made (on both the parent/s and child/ren’s applications) on the basis of any potentially prejudicial information (PPI) in accordance with immigration instructions at E7.15 Potentially prejudicial information, and their application declined if they are not able to meet this requirement.
