Processing of work to residence applications

The advice below is to clarify processing requirements inconsistency around the processing of Work to Residence applications.

Evidence of Qualifications and Work Experience (as per Visa Pak 19 August 2011) Talent visa instructions do not require the applicant to supply evidence of qualifications and/or experience. Requiring these is not appropriate and is contrary to the objective of the specific instructions for Talent (Accredited Employer) work visas.

Note: applicants who work in occupations requiring occupational registration must still provide evidence of their registration, in accordance with WR1.30.

Health and Character Requirements

Work to Residence applicants must meet the residence Health and Character requirements.

Medical Certificates
The Medical Certificate must be less than 3 months old for lodgement.

It has been clarified that A4.25 does not apply and therefore, unless the medical is less than three months old, the applicant must provide a new Medical Certificate or have a previous certificate re validated. Operations Support has submitted a Work Request to Service Support to have this point clarified in the instructions.

NB: The Residence referral form must be used for referring Medicals to the Medical Assessors.

Police Certificates
Applicants aged 17 years or over must provide a police certificate from the country of citizenship and any country in which they have lived for a total of 12 months or more, including New Zealand. [NOTE CORRECTION ADDED BELOW]

Police Certificates must be no older than 6 months at time of lodgement.

Secondary Applicants
Secondary applicants applying as Visitors, Workers and Students dependent on the principal applicant must also meet the same residence requirements as detailed in WF3.1 (c) and V3.10 (d) and U8.20 (e).

Character Requirements

Police Certificates
Applicants aged 17 years or over must provide a police certificate from the country of citizenship and any country in which they have lived for a total of 5 years or more, including New Zealand.

Police Certificates must be no older than 6 months at time of lodgement.
