C4.70 Communications on refugee matters (29/11/2010)

C4.70.1 Methods of communication

Unless otherwise specified, any matter that is to be communicated between a refugee and protection officer and a claimant or person whose refugee or protection status is in question may be communicated by:

  1. personal service; or
  2. by service on the person’s lawyer or agent in accordance with section 386(4) of the Immigration Act 2009; or
  3. registered post addressed to the person’s New Zealand address.

C4.70.5 Receipt of communications

  1. If a document has been given to, served on or sent by registered post to a claimant or other person whose refugee or protection status is in question, the document is to be treated as having been received by the person 5 working days after the date on which it was posted.
  2. C5.70.5(a) applies unless the person proves that otherwise than through fault on the person’s part, the notice or document was not so given, served or received.
  3. If any document is sent by fax, the document is to be treated as having been received at the date and time specified in a record of the successful transmission of the fax that is generated by the machine sending the fax.
