RW8.10 South Island Contribution resident visas for Filipino dairy workers who have provided false documents

  1. These instructions apply to people who:
    1. are nationals of the Philippines; and
    2. are subject to A5.25(i) as an immigration officer has established that, on the balance of probabilities, in the course of applying for a New Zealand visa they provided any statement, information, evidence or submission regarding their work experience that was false, misleading or forged; and
    3. were granted an Essential Skills work visa to work on a dairy farm prior to 1 September 2015; and
    4. are applying for a South Island Contribution resident visa and have ongoing employment, or an offer of employment, on a dairy farm.
  2. Despite the requirement that applicants be of good character (RW8(e)), applicants who meet the requirements of RW8.10(a) may still be granted a South Island Contribution resident visa if they:
    1. have not withheld information or provided further false, misleading or forged information in the course of applying for a New Zealand visa since the grant of the visa which satisfied the requirement at RW8.10(a)(iii); and
    2. meet all other criteria for the grant of a South Island Contribution resident visa, including not falling under any of the provisions of A5.25 other than A5.25(i).
