WJ1.15 Exemptions from the requirement to be a New Zealand ship

  1. Section 103A of the Fisheries Act 1996 details situations in which the chief executive can exempt a vessel from the requirement to be a New Zealand ship. In situations where an exemption to this requirement has been granted and the employer has made an AIP application or is supporting a work visa application for foreign crew, the application should be considered as an exception to instructions.
  2. Where WJ1.15(a) applies, immigration officers should give consideration to whether the employer meets the requirements that a New Zealand employer would need to meet under WJ instructions.
