D4.11 Limited power of detention for up to 4 hours

A person liable to arrest and detention under Part 9 of the Immigration Act 2009 (the Act) may be detained by an immigration officer authorised under section 388(2) of the Act (see A15.1.20) for a purpose set out in section 310 of the Act until the earliest of:

  1. the exercise by a constable of the power of arrest and detention under section 313 of the Act; or
  2. the delivery of the person into custody under the Act; or
  3. the person no longer being liable to arrest and detention under Part 9 of the Act; or
  4. the purpose of the detention being achieved; or
  5. the elapsing of 4 hours since the detention commenced.
