BJ5.1 Ability to apply

Immigration Act 1987 13B (3A), 13E(2)

A person may only apply for residence under the Investor 2 Category if:

1. they have been issued with an Invitation to Apply (ITA) under the Investor 2 Category; and
2. they apply for residence under the Investor 2 Category within three months of the date of the letter in which that invitation is made; and
3. that ITA has not been revoked.
