A15.35 Delegation of the Power to Grant a Permit of a Different Type from that for which an Application is made

I, PAUL DESMOND SWAIN, MINISTER OF IMMIGRATION, acting pursuant to section 131(1) of the Immigration Act 1987, hereby delegate to:

  1. all immigration officers who are the holders (or are acting as the holders) of the following positions:
    1. Secretary of Labour;
    2. General Manager, New Zealand Immigration Service;
    3. Chief Operating Officer, New Zealand Immigration Service;
    4. Service Excellence Manager, New Zealand Immigration Service;
    5. Manager, Policy Research and Development, New Zealand Immigration Service;
    6. Market Manager, New Zealand Immigration Service;
    7. Service Manager, New Zealand Immigration Service; and
  2. all immigration officers who are found in Levels 1 or 2 of the Interim Competency Schedules held by the General Manager of the NZIS

the power conferred by section 35 of the Immigration Act 1987 to grant a permit of a different type from that for which an application is made.

Any person who exercises any power pursuant to this Instrument of Delegation shall do so in accordance with the Government policy and Departmental instructions (if any) that are current at the time, or set out from time to time in the Departmental Manual of Instructions or through individual circular instructions on Immigration.
