Y3.25 Persons to whom section 7(1) applies but who are not refused entry

Immigration Act 1987 ss 7(3)(a)(ii) and (iii), 27A

  1. If, after interviewing a person suspected of being subject to section 7(1) of the Immigration Act 1987, an immigration officer determines that section 7(1) does apply but there are compelling reasons to grant a permit, an exception may be made and an appropriately delegated officer may grant a permit by special direction under section 7(3)(a)(ii). If a special direction is given, the permit granted should be of a type and duration appropriate to the reasons for the special direction.
  2. An exception may also be made and a permit granted to enable a person:
    1. to give or provide evidence in New Zealand; or
    2. to be transported through New Zealand; or
    3. to return to New Zealand to face any charge or serve a sentence.
