Examples of eligibility

Not sure whether a prospective student from overseas is eligible to apply for a visa or permit?  These examples will give you an idea of the situations under Section 7(1) of the Immigration Act 1987 where, generally, a person won’t be eligible to apply for a visa or permit.

 

Even where a prospective student from overseas is eligible to apply, we’ll still thoroughly assess their application before making a decision on whether we’ll grant a visa or a permit.

They were released three years ago after serving a six-year prison sentence. No
They were released 15 years ago after serving a nine-month prison sentence. Yes, they’re eligible to apply
They were released 11 years ago after serving a 12- month prison sentence. Yes.  They’re eligible to apply, provided they were sentenced to less than five years and were released over 10 years ago
They were arrested, though not convicted, of drug trading. Yes, they’re eligible to apply
They have been deported from another country. No
They’ve been alleged to be, or have been, involved in terrorist activities. No
They've been deported from New Zealand in the past. No
They’ve been refused entry to another country. No
