Role of the NZIS

This version of the New Zealand Immigration Service (NZIS) Operational Manual replaces the one that came into effect on 30 October 1995. It brings together the policy, procedures, and many of the legal provisions that govern NZIS operations, and is designed so that users looking for information on a particular aspect can find the relevant material in one place. Any important related material can be accessed through cross-references or - in the electronic version - links.

Policy

By containing Government policy, this Manual meets the requirement of section 13A of the Immigration Act 1987 that Government policy for visas and permits be published. The policy provisions of the Residence and Administration parts in particular contain Government residence policy as defined by section 13B of the Act.

Government policy is expressed in the Manual in terms of the criteria that applicants must meet, the evidence they must produce to show that they meet the criteria, and the processes for assessment and verification of applications.

This Manual also provides additional relevant information for users in the attached appendices.

Legal provisions

Certain provisions in this Manual summarise relevant sections from the Immigration Act 1987 and the Immigration Regulations 1991, as well as other statutes and international agreements. In many cases the precise legislative references follow immediately after the section or subsection heading. Note that the legal provisions do not in themselves constitute Government immigration policy.

Legal references

References to the Immigration Act and Immigration Regulations are set out in italics following the title of certain policy provisions. These are intended as a guide to the legal provisions relevant to the particular policy provision that they precede, and are not necessarily comprehensive.

To the extent that references to the Immigration Regulations have been amended in the Operational Manual from the "Immigration Regulations 1991" to the "Immigration Regulations 1999", the amended references have effect from 1 October 1999.
